Investment $XXX Terms and Conditions 1.0 Vendor Exclusivity It is understood that the Client is hiring Anaya Photography as the sole exclusive official photographer retained to perform the photographic services detailed in this agreement. Anaya Photography has the first right of refusal of any additional professional photography services provided at this event, not included in this agreement. The Client’s failure to comply with this agreement releases Anaya Photography from any and all obligations defined in this agreement. 2.0 Payment Policy and Expenses A minimum of $500 (non refundable) is paid to retain photographic coverage for the services detailed in this agreement. The remaining balance will be paid by the Client no later than one week prior to the wedding date. If the balance is not paid one week prior to the wedding, all monies paid excluding the retainer will be refunded and no photography services rendered. Should any balance still be owed, for any reason after the date the services are rendered, a $100 late payment fee in addition to the balance will be assessed before any deliverables will be turned over to the Client. If applicable, all travel fees including air fare, hotel, transfer taxes and toll expenses incurred by Anaya Photography in association with performing the photographic duties expressed herein will be paid by the Client. Mileage charges will apply for all travel in excess of 150 miles (roundtrip) from the 21221 zip code. The prevailing IRS mileage rates will apply. All fees are non-refundable. Non-payment of any fees as described above releases Anaya Photography from any and all obligations defined in this agreement. Anaya Photography accepts cash, check, all major credit cards, PayPal, CashApp, Zelle or money orders. Make all checks payable to “Anaya Photography”. Any returned checks will incur a $35 returned check fee. 2.1 Meals The Client shall provide all contracted Anaya Photography staff meals during engagements lasting 4 or more hours when meals are served as part of the event. It is preferred that Anaya Photography staff is permitted to dine at the same time as the primary subjects of the event, as to minimize the possibility of missing any key photographs. 3.0 Product Pricing Current pricing is specified in this agreement. All packages include the specified album, along with all professional services and image editing time. Any other products or services are available for an additional charge. Additional prints will be made available at www.anayaphoto.com for purchase. Anaya Photography warrants that all prices quoted for professional services, photographs, and albums are valid for a period of six months following the date of the wedding. Orders placed after this period of time are billed at Anaya Photography’s current pricing, which is subject to change. 4.0 Quality Standard & Final Prints All images will be professionally reviewed to ensure optimal print quality. Our quality standards are measured by five guidelines: 1. Visibility of highlight details; 2. Visibility of shadow details; 3. Whites are clean with no overall color cast; 4. The image has no overall color bias (this does not apply to color balance for lighting conditions); 5. Flesh tones are believable. Lighting conditions and movement provide constant challenges, therefore, we cannot guarantee the quality of any image; however, Anaya Photography will make every effort to ensure the overall quality of all images. 5.0 Limitation of Liability While every reasonable effort will be made to produce and deliver outstanding photographs of the wedding events, Anaya Photography’s entire liability to the Client for any claim, loss, or injury arising from our performance is limited to a refund to the Client of all fees paid. Because this is an uncontrolled event, Anaya Photography cannot guarantee delivery of any specifically requested image(s). 6.0 Review and Selection Proof images will be presented to the client for viewing usually within three weeks of the event. Anaya Photography will then begin the album design process if an album was ordered. After the album design is presented to the Client, the client is responsible for confirming a final version of the album to be printed within 6 months of presentation of the initial design. Should a final album not be approved to be printed within the 6 month timeframe, an additional $200 fee will be assessed to cover current album printing prices. Custom albums are ordinarily delivered within 2 months after receipt of the final album design approval. 7.0 Date Changes / Cancellations Should a wedding date need to be changed, Anaya Photography will make every effort to accommodate the change requested. We cannot guarantee your new date will be available, but if it is, no penalties will be assessed for the first change. Should the new date not be available, all monies excluding the retainer fee will be refunded. Should the wedding be canceled altogether more than one month in advance of the wedding date, the Client will be refunded all monies paid excluding the retainer fee. If the wedding is canceled within 30 days of the wedding date, the Client will forfeit all monies paid including the retainer fee. 8.0 Ownership of Images Anaya Photography retains copyright to any and all images produced in connection with this agreement. Reproduction of any image produced in connection with this agreement is prohibited without specific written consent of, or purchase of thumb drive from Anaya Photography. The parties agree that Anaya Photography may reproduce, publish or exhibit a judicious selection of such images as samples of photographic work to be shown to prospective clients and for instructional or institutional purposes consistent with the highest standards of taste and judgment. Clients agree to hold Anaya Photography harmless against any and all claims arising from any published images. This is the agreement in full and cannot be amended by any party. This agreement is made, and, in all respects, is to be construed under the laws of the State of Maryland and the United States. The parties agree that any dispute over this agreement will be adjudicated in a State of Maryland court located in Baltimore County, Maryland and expressly agree to the judgment of such court.
